These Terms of Service (“Terms”) govern your access to and use of thedailycrimp.com, including the Senderella Lite and Senderella+ services (together referred to as the “Senderella service” or the “Service“), and any content, functionality, and services offered through the site (collectively, the “Website” or “Services”). By accessing or using our Website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or the Senderella service.

Throughout these Terms, “you” or “User” refers to the individual accessing the site or using our services. “We” or “The Daily Crimp” refers to the owner/operators of thedailycrimp.com.

Please read these Terms carefully, as they contain important information about your rights, obligations, and limitations, including sections that limit our liability and disclaim warranties, and a section on No Refunds for Digital Products.

  • Use our content or Services for any commercial purpose outside the scope explicitly permitted (for instance, you shouldn’t resell or redistribute the outputs of the Senderella+ tool, or copy our blog content to your own site without permission).
  • Impersonate any person or entity, or submit information on behalf of someone else without their permission.
  • Harass, abuse, or harm others through any interactions on our site (e.g., if there are comment sections or forums, which at present we do not have).

If you violate any of the above or any other provision of these Terms, we reserve the right to terminate or suspend your access to the Website and Services (see Section 8 Termination below).

2. Description of Service (The Daily Crimp Blog and Senderella Tool)

The Daily Crimp Blog: thedailycrimp.com is a blog focused on rock climbing. We provide articles, tips, gear reviews, and other climbing-related content. All such content is provided for general informational and entertainment purposes. While we strive for accuracy, the content may not always be up-to-date or applicable to your specific situation. We do not guarantee the accuracy, completeness, or usefulness of any editorial content. You should use your own judgment and experience when applying any advice or information from our blog to your own climbing activities.

Senderella Lite (Free Service): Senderella Lite is our free digital tool that suggests climbing shoes based on user-provided preferences. You can input information such as your climbing style, experience level, foot shape, or other preferences, and Senderella Lite will generate a recommendation or a list of recommended climbing shoes that might suit your needs. This service is provided instantly on the site without any login or payment. No personal data (like your name or contact info) is required to use Senderella Lite – it works purely based on the preference inputs you provide at the time of use.

Senderella+ (Premium Service): Senderella+ is an upgraded, premium version of the shoe recommendation tool. It may offer more personalized or detailed recommendations, additional features (for example, filtering by advanced criteria, accessing a larger database of shoes, or saving your profile for future suggestions), or other premium content. Senderella+ is a digital service that requires a purchase before use. Upon purchase, you will gain one-time access to Senderella+ features (which might be through unlocking features on the site or receiving a digital report, etc., depending on how the service is structured). No physical goods will be shipped – all benefits of Senderella+ are delivered electronically (through our website or via email). By purchasing Senderella+, you acknowledge that you are buying a digital product/service that provides information, and not a tangible item.

IMPORTANT: When you purchase access to Senderella+, you gain ONE-TIME access to the digital service.

Recommendations, Not Endorsements: The recommendations provided by Senderella Lite/Plus are generated to help you discover climbing shoes that might work for you based on the information you give. However, The Daily Crimp does not endorse or guarantee any particular product. We are not affiliated with any specific climbing shoe manufacturers or retailers, and we do not receive compensation for featuring any specific shoe in the recommendations. Any mention of brands or specific products on our site (whether in the blog or via Senderella) is for informational purposes only. We strongly advise you to do your own research, try on shoes where possible, and consider your personal needs before making any purchase decision. The final decision and responsibility of choosing and using a climbing shoe (or any gear) rests with you.

No Professional Advice: While our team includes experienced climbers and we strive to provide useful advice, any information or recommendation on thedailycrimp.com should not be considered professional or expert advice tailored to an individual. For example, foot shape, injury history, or specific medical needs can affect what shoe is appropriate – those are factors our general tool cannot account for. Always consult professionals (like a climbing coach or a medical professional for foot-related issues) if you need personalized advice. The Senderella service is a helpful guide, not a definitive authority.

Service Availability: We aim to keep our Website and Senderella services up and running smoothly. However, we do not guarantee that the service will be available at all times or at any given time. There may be occasional outages, maintenance windows, or technical issues that interrupt or limit the functionality of the site or tool. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice (though if you have an active paid access to Senderella+, we will strive to minimize disruptions and provide fair access to what you paid for).

3. Purchases, Payments, and Accounts

Pricing and Currency: All prices for Senderella+ (and any other paid services, if introduced) are clearly displayed on our site at the point of purchase. Unless otherwise stated, prices are listed in United States Dollars (USD). If you are purchasing from outside the United States, be aware that the currency will be converted by your payment provider or bank if needed, and you are responsible for any applicable taxes, currency conversion fees, or bank charges. We will always inform you of the transaction currency and amount before you complete your purchase.

Payment Processing: Payments for Senderella+ are handled through Stripe, a secure third-party payment processor. When you proceed to purchase, you will be redirected to a secure checkout page or have a secure payment form on our site powered by Stripe. All payment details you provide (such as credit card number, expiration date, CVV) are transmitted directly to Stripe over encrypted connections (SSL/TLS). We do not see or store your sensitive payment information on our servers. Stripe may store your payment details in accordance with their own security standards (PCI-DSS compliant) to process the transaction. By making a purchase, you agree to Stripe processing your payment and you are subject to Stripe’s Services Agreement and Privacy Policy in the context of payment processing.

Billing Information: You must provide current, complete, and accurate purchase and account information for all purchases. This includes a valid email address (so we can send you a receipt or any necessary information regarding your purchase) and any other details requested. By submitting payment information, you represent and warrant that you have the legal right to use the payment method provided.

Delivery of Service: Upon successful payment, we will deliver the digital service. Delivery may consist of:

User Account (if applicable): At this time, The Daily Crimp does not require a user account for general browsing or using Senderella Lite. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a breach of security, you must notify us immediately. We are not liable for any loss or damage arising from your failure to safeguard your account information or use a secure password.

Promotions and Coupons: We may occasionally offer promotional codes, discounts, or trial periods for Senderella+. Such promotions will be governed by additional terms and may be subject to eligibility criteria and time limits. Any such offer is valid only for the period and under the conditions stated, and we reserve the right to modify or withdraw promotions at our discretion.

4. Refund Policy for Digital Purchases

All Sales Final – No Refunds: All purchases of Senderella+ (or any other digital products we may offer) are final. Due to the intangible and immediate-access nature of digital services, we do not issue refunds once you have purchased and gained access to Senderella+. By completing a purchase, you understand and agree that you will not be entitled to a refund or exchange. This policy is in place because digital content and services are consumed as soon as access is granted – unlike a physical product, it cannot be “returned” in the same way.

We provide detailed information about Senderella+ on our site (such as what features it includes and how it works). Please review these details carefully before purchasing to ensure the product meets your expectations. If you are unsure about whether Senderella+ is right for you, we encourage you to try Senderella Lite first (since it’s free) or contact us with any questions.

Factors Outside Our Control: We specifically do not provide refunds for issues that are outside the control of The Daily Crimp, including but not limited to:

  • User-side Technical Issues: Problems with your own device, software, or internet connection that prevent you from accessing or using Senderella+. For example, if your internet drops during use, your browser is not updated or incompatible, or you have device malfunctions, we are not responsible for these issues. Our service is delivered as-is; you are responsible for meeting the minimum technical requirements (modern web browser, internet access, etc.) to use it.
  • Failure to Accept Cookies or Follow Instructions: If you or your browser settings block cookies or necessary scripts, the Senderella service may not function properly. As explained in our Cookie Policy, certain cookies are required for the digital tool to work (to maintain your session or inputs). If you refuse these and as a result the service fails, that is considered a user choice outside our control. Similarly, not following provided instructions or guidelines for using the tool can lead to suboptimal or no results, which is not a basis for a refund.
  • Misunderstanding of the Product’s Nature: Purchasing Senderella+ under the incorrect assumption that it is something other than what it is (for example, thinking it would result in a physical product like actual shoes, or believing it guarantees you will climb better without effort). We strive to make it clear that Senderella+ provides recommendations for climbing shoes, and is a digital informational service, not a physical item or a personalized coaching session. Misinterpretation of the service’s purpose by the user is not the fault of The Daily Crimp, and thus not grounds for a refund.
  • Change of Mind: Simply deciding that you no longer want the product after access has been granted is not eligible for a refund. Once you have received the information/service, it cannot be unseen or returned.

Exceptional Circumstances: If you believe you have a case of exceptional hardship or you did not receive what was promised due to an error on our part, please reach out to us at crimpingdaily@gmail.com. While our default stance is no refunds, we do care about user satisfaction. If a genuine mistake occurred on our side (for instance, you were charged but never got access due to a system error on our end), we will investigate and work with you to make it right, which may include granting access properly or, in rare cases, a refund if required by consumer protection laws. Any decision to provide a refund in such cases is at our sole discretion and does not indicate a change in our general no-refund policy.

Legal Right of Withdrawal (EU Customers): If you are a consumer in the European Union or a jurisdiction with similar consumer protection laws, you may be accustomed to a “cooling-off” period (e.g., 14-day right of withdrawal for online purchases). Please note: When you purchase Senderella+, which is a digital service delivered immediately, by completing the purchase you expressly consent to immediate performance of the service and waive your right of withdrawal. This is in accordance with EU consumer law (Directive 2011/83/EU on consumer rights) which allows digital content to be non-refundable once access is provided with consumer consent. In plain terms, this means that because you can use Senderella+ right away, you do not have the automatic right to cancel it for a refund after access is given. We make this clear at purchase time if applicable. This does not affect any rights you may have if the product is faulty or not as described, per applicable law.

We will make reasonable efforts to assist you in resolving technical problems or answering questions about the product. Our goal is for you to receive the full value of what you paid for. Even though we maintain a no-refunds policy, we do want you to have a working product experience. Many issues can be resolved by adjusting browser settings or providing additional guidance, and we’re happy to help. However, reaching out for support does not guarantee a refund; it is aimed at helping you utilize the service successfully.

By completing a purchase on our site, you acknowledge that you have read and understood this refund policy, and you agree to it.

5. Intellectual Property

The Daily Crimp Content: All content on thedailycrimp.com, including but not limited to text, articles, blog posts, graphics, logos, images, software code, and the organization and layout of the site, is the intellectual property of The Daily Crimp or its content suppliers and is protected by copyright, trademark, and other applicable intellectual property laws. “The Daily Crimp” and “Senderella” are trademarks or service marks owned by us. All rights not expressly granted to you in these Terms are reserved by The Daily Crimp and/or our licensors.

Your Use of Our Content: You may temporarily download or print one copy of portions of our content for your personal, non-commercial use and informational purposes (for example, printing a blog article to read later for your own reference). However, you must not:

If a shoe recommended by Senderella turns out to be ill-fitting or unsuitable and causes discomfort or injury, The Daily Crimp is not liable for those outcomes. You assume full responsibility for testing and using any gear.
  • Incorrect Use of Service: If you use the Senderella service incorrectly or outside its intended scope (for example, entering nonsensical data, or ignoring recommended usage guidelines) and as a result you get poor or unexpected results, you agree that this is not the responsibility of The Daily Crimp. Similarly, if you circumvent restrictions or use the tool in a way that was not intended, any consequences are on you.
  • Third-Party Acts: Any issues arising from services or products provided by a third party, even if you learned about them through our site. For example, if you purchased Senderella+ for $20, and you believe something about that service caused you damage, at most our liability would be $20 (assuming no laws mandate additional liability). If you have not made any payments to us (i.e., you only used free content), then we have no financial liability to you for any damages, to the extent permitted by law.

Consumer Law Rights: Some jurisdictions (including certain states or countries) do not allow the exclusion or limitation of certain liabilities. In such jurisdictions, our liability will be limited to the fullest extent permitted by law. Nothing in these Terms is intended to exclude or restrict any liability that cannot be excluded by law, such as liability for death or personal injury resulting from our negligence or for fraudulent misrepresentation.

By using our site and Services, you agree that The Daily Crimp will not be held liable for any damages or losses, except as expressly provided in this section. You acknowledge that the pricing of any paid services (if any) reflects this allocation of risk and the limitation of liability specified herein.

If you wish to terminate your account (in case accounts exist for Senderella+ or other features), you may do so by contacting us. Stopping use of the site or uninstalling any related app (if any) will also constitute discontinuation of use. Keep in mind that even after you stop using the site, certain provisions of these Terms will remain in effect (see “Survival” below).

Termination by Us: We reserve the right to suspend or terminate your access to the Website or Services (or certain features of the Services) at any time, with or without notice, for any valid reason. This could include, for example, if we believe you have violated these Terms, if you have engaged in fraudulent or inappropriate behavior, if your use poses a security threat, or if we cease offering the Service. In most cases, if you have a paid subscription and we terminate the service not due to your breach, we would provide a pro-rata refund for any remaining period of an unused subscription. However, if termination is due to your breach of these Terms or misconduct, you will not be entitled to any refund.

Effect of Termination: Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, limitations of liability, indemnity, and governing law) will survive.

10. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. We choose Swedish law as our governing law because The Daily Crimp is operated from Sweden.

If you are a consumer residing in the European Union or another country, this choice of Swedish law is not intended to deprive you of any protection afforded by the mandatory consumer protection provisions of your country of habitual residence (meaning you may additionally have rights under your local laws).

Jurisdiction: Any dispute or claim arising out of these Terms that cannot be resolved amicably shall be brought in the courts of Sweden. By using our site, you agree to submit to the personal jurisdiction of the courts located in Sweden for the purpose of litigating such disputes. Notwithstanding this, we reserve the right to seek injunctive or other equitable relief in any jurisdiction to prevent irreparable harm.

For users in the EU, you also have the right to seek resolution through the EU Online Dispute Resolution (ODR) platform or other alternative dispute resolution methods, though we make no commitment to use a particular ADR unless required by law.

11. Compliance with Stripe and Card Network Requirements

We strive to comply with all requirements set by our payment processor (Stripe) and card networks (Visa, MasterCard, etc.). By making a purchase on thedailycrimp.com, you agree to provide information that is truthful and to abide by any terms required by the payment processing (for instance, you won’t use a stolen credit card, you won’t dispute a valid charge as fraudulent, etc.). We have provided on our site:

  • A clear description of the digital service offered (Senderella+).
  • The transaction currency and price before purchase (see Section 3).
  • Our contact details for customer service (see Section 12).
  • Our refund policy (Section 4) which you are acknowledging prior to purchase.
  • Our privacy policy and security measures (so you know your data is handled safely).

If you do not agree to the new terms, please stop using the site and Services.

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy (and any additional terms provided when you purchase Senderella+ or other services), constitute the entire agreement between you and The Daily Crimp regarding your use of our Website and Services. They supersede any prior agreements, communications, or proposals, whether oral or written, between us and you regarding the subject matter herein.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions of the Terms will remain in full force and effect. In other words, the invalid part will be cut out or narrowed, and the rest of the Terms will still apply.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If we delay or fail to take action in response to your breach of these Terms, it does not mean we are giving up our rights to enforce these Terms against you or in any similar situation later.

Assignment: You may not assign or transfer any of your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

Headings: Section headings in this agreement are for convenience only and have no legal or contractual effect.

Language: These Terms are written in English. If these Terms are translated into another language and there is a discrepancy between the English text and the translated text, the English text will govern (to the extent allowed by law).
